The cargo manifests were inputted onto a port system 13 minutes past the deadline for 200 containers.
As a result, when the ship arrived into port, the port did not know where to direct the containers and they had to be put into storage for four days whilst the port investigated. It was the ship agent's responsibility to manifest the cargoes that arrive at the terminal in a timely manner and that did not happen in this case (even though the agent had received the relevant information in good time).
The agent faced liability for the delay costs associated with storing the containers whilst the information was pending. Whilst it was clear that the agent was at fault in this case and could not escape liability, ITIC assisted the agent in challenging the level of the costs levied by the port authorities. The claim was settled for 15% of the original charge (US$ 13,000 down from US$ 86,000) and was paid by ITIC.
